Terms of Service

1. About These Terms

These Terms of Service ("Terms") govern your access to and use of Real Estate Viewers ("we", "us", "our") (ABN pending), including our website at realestateviewers.com and the buyer pipeline application ("Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or the organisation you represent. The Service is intended for use by licensed real estate agents and agencies operating in Australia.

3. Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at support@realestateviewers.com if you suspect unauthorised access. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Plans and Billing

The Service is offered on the following plans:

  • Free trial: 1-month trial on the Starter plan, no credit card required
  • Starter: A$79/month, billed monthly
  • Pro: A$150/month, billed monthly
  • Agency: A$299/month, billed monthly

Features available on each plan are described on our Pricing page and may change with reasonable notice.

Payments are processed securely via Stripe. Subscriptions renew automatically each month unless cancelled before the renewal date. Refunds are issued at our discretion and are generally not provided for partial billing periods.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation
  • Upload, transmit or store content that is defamatory, fraudulent, or infringes the rights of any third party
  • Attempt to gain unauthorised access to any part of the Service or its infrastructure
  • Reverse engineer, decompile, or otherwise attempt to extract the source code of the Service
  • Use the Service to send unsolicited communications in violation of Australian spam laws
  • Resell or sublicense access to the Service without our written consent

6. Your Data

You retain ownership of all data you input into the Service, including buyer records, project details, and messages ("Your Data"). You grant us a limited licence to process Your Data solely for the purpose of providing the Service. We do not sell Your Data to third parties. Please review our Privacy Policy for full details on how we handle your information.

7. Intellectual Property

All content, features, design, and technology comprising the Service — excluding Your Data — are owned by or licensed to Real Estate Viewers and protected by Australian and international intellectual property laws. You may not copy, modify, or distribute any part of the Service without our express written permission.

8. Third-Party Services

The Service integrates with third-party platforms including Stripe (payments), Twilio (SMS/WhatsApp), HubSpot, Salesforce, and Unlatch (CRM sync). Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the conduct of any third-party service.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. To the extent permitted by Australian Consumer Law, we disclaim all implied warranties including merchantability and fitness for a particular purpose.

10. Limitation of Liability

To the maximum extent permitted by law, Real Estate Viewers' total liability to you for any claim arising out of or relating to these Terms or the Service will not exceed the total fees you paid to us in the three months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages. Nothing in these Terms limits liability that cannot be excluded under the Australian Consumer Law.

11. Termination

You may cancel your account at any time through the Settings page. We may suspend or terminate your access immediately if you breach these Terms. Upon termination, your right to use the Service ceases. We may retain Your Data for a reasonable period as required by law before deletion.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
